Threesome Act Gets $3 Million
The family of the Georgia man, who died during a threesome, has been awarded $3 million in a medical malpractice lawsuit.
William Martinez, 31, the victim, was married and father of two sons.
According to Edmund and Lindsay, an Atlanta law firm, the man was evaluated by cardiologist Dr. Sreenivasulu Gangasani. The victim complained of chest pain that radiated up his arm. The test reports showed that the victim had heart related risk factors.
The doctor scheduled a test for eight days later but did not inform the man to stop all physical activities.
A day before the scheduled test date, the victim died during a threesome with a man and a woman (not his wife)
Martinez,'s widow filed a case of medical negligence against the doctor. The jury found that the victim should have been given immediate test and not be allowed to go home.
“Our case was strong on the medicine but the case was particularly challenging and unusual due to some extraordinary and sensational facts surrounding the victim’s death,” said Dr. Edmond
The initial award was $ 5 million but the jurors found that the man was 40 percent responsible for his death and so the amount was reduced to $ 3 million.
"We give credit to the jury for their ability to not be distracted by the sensational facts of how Mr. Martinez died. They followed Georgia law, found that the doctor was negligent, and understood that Mr. Martinez could have died after any act of exertion, even the type he would do on his job. With this verdict, the victim’s widow and their two young sons will benefit,” says Dr. Edmond at Edmond & Lindsay, in a statement.
“We’re definitely going to appeal the verdict and the judgement,” said Gary Lovell Jr., who represented Gangasani and CardioVascular Group, reports CBS At
